Welcome to The Paper Trail (the "Website"). This Website is owned and operated by Paul Vale ("we," "us," or "the Artist"). By accessing or using this Website, or by purchasing artwork through it, you agree to be bound by these Terms and Conditions.

1. Intellectual Property & Copyright

Ownership: The Artist retains 100% of the copyright, reproduction rights, and moral rights to all original artwork, prints, custom commissions, text, and images displayed on this Website.

Restrictions: The purchase of a physical artwork or print does not transfer any copyright or commercial reproduction rights to the buyer. You may not copy, scan, resell, print merchandise from, or license any images from this Website.

AI & Emerging Media: You are strictly prohibited from using any artwork or images from this Website to train artificial intelligence (AI) models, machine learning algorithms, or data scraping tools. No artwork may be converted into Non-Fungible Tokens (NFTs) without explicit, written permission from the Artist.

2. Product Information & Disclaimers

Screen Display Color Warning: We make every effort to display the colours of the artwork accurately. However, because computer and mobile screens differ in calibration, we cannot guarantee that your screen's display of any colour will perfectly match the physical artwork.

Sizing: All dimensions listed on the Website are approximate. Please read individual item descriptions carefully to check whether the artwork arrives framed or unframed.

Inventory Control: We reserve the right to modify, update, or withdraw any artwork from sale at any time without prior notice, including items that may have sold simultaneously at an in-person exhibition.

3. Custom Artwork & Commissions

Deposits: All custom artwork requires a 30% non-refundable deposit before work begins. This covers time and material costs.

Approval Process: The buyer will receive digital progress proofs. Once the final proof is approved by the buyer, the balance payment is due, and the order cannot be cancelled or refunded.

Usage Restrictions: Unless agreed otherwise in writing, custom commissions are for personal display only and may not be used for corporate branding or commercial gain.

Fulfillment: Processing times (preparing and packaging your art) are separate from shipping transit times. Estimated processing times are listed on individual product pages.

Damaged Goods: If an artwork arrives damaged during shipping, you must contact us at paulvale126@outlook.com within 48 hours of delivery. You must provide clear photographs of both the damaged packaging and the damaged artwork to initiate a claim or replacement.

Customs Duties and Import Taxes: Buyers are entirely responsible for any customs duties, import VAT, or local handling fees that may be applied by their country's customs department upon arrival. We are not responsible for delays caused by customs services.

The Paper Trail only delivers to addresses in the UK. Any overseas purchases will need to be negotiated, on a one-to-one basis.

5. Returns, Cancellations, and Refunds

Standard Art & Prints: Buyers have the right to return standard, non-customised items within 14 days of delivery. The item must be returned unused, undamaged, and securely packaged in its original wrapping.

Return Shipping Costs: The buyer is responsible for return shipping costs and must use a tracked, insured shipping service. A refund will only be processed once the artwork is received back in its original condition. The cost of shipping is included with each purchase and will be deducted from any refund.

Exemptions: Custom commissions, made-to-order bespoke prints, and digital downloads are strictly non-refundable and exempt from standard return policies unless they arrive damaged.

6. Limitation of Liability

Service Availability: This Website is provided on an "as is" basis. We do not guarantee that the website will always be error-free or uninterrupted.

Pricing Errors: In the rare event that an artwork is listed at an incorrect price due to a system glitch or typographical error, we reserve the right to cancel the order and issue a full refund.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom and any legal disputes will be subject to the exclusive jurisdiction of the courts in the UK
